Sabah cannot begin ending its plight in Malaysia until all the parti parti Malaya are out of the Territory.

There are many issues in Sabah and Sarawak where the people have lost sovereignty since 1994 (after Pairin) and 1966 (after Ningkan).

The onus lies on the international community, under international law, for restoring sovereignty where a people had lost it.

Sarawak’s loss of sovereignty began when the Stephen Kalong Ningkan government was dismissed by emergency decree. No Orang Asal has been Chief Minister of Sarawak after Penghulu Tawi Sli in 1970. Orang Asal make up half the population in Sarawak, Christian form 70 per cent.

No Orang Asal and Christian have been Governor of Sarawak since 1963.

In Sabah, the people lost sovereignty after dubious voters entered the electoral rolls. The 2013 RCI (Royal Commission of Inquiry) on illegal immigrants (PTI or pendatang tanpa izin) concluded that “the Projek IC Mahathir probably existed”.

The Federal government has imposed proxy government on Sabah and Sarawak since 1976 (Harris Salleh) and 1994 (after Pairin) and since 1966 (after Ningkan).

There has been internal colonisation in the form of non-compliance on the Malaysia Agreement 1963 (MA'63), the basis for the Equal Partnership of Sabah, Sarawak and the Federation of Malaya in Malaysia. That saw the imposition of grinding poverty on the people.

Malaysia isn't Federation. The Federation stands defined in the Federation of Malaya Agreement 1948.

The British transferred the administration of the territories of Sabah and Sarawak on 16 September 1963.

The former British Borneo territories, Sabah and Sarawak, became Malaysian Borneo territories. Sabah and Sarawak have the right, under international law, for self-determination.

Colonialism stands defined and banned by international law, after World War II, as form of criminal enterprise for accumulating capital by transferring wealth from those who have no power for those with power.

International law also banned political supremacy and domination based on race and religion -- read ketuanan Melayu -- as seen in Nazism, Fascism and Apartheid, Islamic state, political Islam, state based on religion, and the caste system which prohibits upward social mobility.

The caste system was based on distortion and misinterpretation of Karma, the law on cause and effect discovered by ancient India.

The caste system exists in Malaysia based on institutionalised discrimination driven by "one race, one religion, one language".

In law, Article 8 in Malaysia, there can be no discrimination save as provided by law in the form of sunset clause which must have expiry date. There can be no one above the law. All are equal before the law.

The 15 year sunset clause which propped up Article 153, under Article 8, expired in 1972. The sunset clause was talking point during the Reid Commission on the Federal Constitution but were never included in the Report.

The institutionalised discrimination continues under Article 4, with the court disregarding the matter and the Conference of Rulers looking the other way.

The Indian Diaspora in Malaya has been most affected by institutionalised discrimination. Former rubber estate workers, having no new skills, have been reduced to grinding poverty in the twilight zone permeating the shantytowns along the west coast of Malaya. This stretch of territory has historically been Tamil Eelam (homeland) in Malaya.

Racist politicians have argued that Article 153 can continue indefinately under the so-called Social Contract between the subjects of the Sultan as seen in the Malay form of identity defined in Article 160 and British subjects in Malaya on citizenship rights.

The Federal Constitution, the only Social Contract in constitutional law and jurisprudence, enshrines citizenship rights. British subject status was exchanged for citizenship under the Federation of Malaya Independence Act 1957 which reinforced the Federation of Malaya Agreement 1948.

MA'63 also spells out citizenship rights.

The facilitating clauses for Article 153, now redundant, were also rendered redundant in 1972 viz. Article 3 (Islam as religion of the Federation of Malaya), the Definition of Malay in Article 160 as form of identity based on being Muslim habitually speaking the Malay language defined in Article 152 as the national language and being born or domiciled in Singapore or Malaya by Merdeka (independence) on 31 August 1957.

There's case for enlarging the consumer economy, based on the NMT (New Monetary Theory), for eradicating poverty in Malaysia once and for all.

The consumer economy in Malaysia stands at 65 per cent of the GDP. In India, by comparison, it's 60 per cent, below 50 per cent in China, and at 75 per cent in the US.

About 40 per cent of the people in Malaysia were living in poverty before the pandemic. That figure, by many estimates, has increased and may be somewhere near 60 per cent.
